Reposting query use of" offical letter" not obtained officially
My query is as below followed by type of document . once again in dilemma where i lost as not posting it properly as most replied unable to understnad without reasoning "why" from my side as per best of my knowledge and beliefnothing more i can explain my question.
Query:-
I used a document which was true but not directly from central government, but by third person whom i really do not remember , might be taken and saved from whatsapp and used to get promotion. document is genuine and photocopied. is it illegal to produce such document in request to government for getting my rights in my official post.what does civil, central or any other rule applicable in this case. will it be considered as offence.
Document title- memorandum and not either as classified or confidentiial
Got from source forgotten- might be as jpeg from whatsapp or from a colleague
Document is not available outside office . do not know how my colleague got access and posted??on ??whatsapp. but document is genuine and available in headquarters of central government where i work. only mistake is that it was not obtained by me by rti.
Is as per any csr, or any civil or criminal rules or law or act can i be made laible if yes why if no what is quantum of punishment.

Used to get my rights by putting application to consider my rights as per contents of the letter.. different opinon from so may learned colleague with my due apologies asre either they did not understood and no more information i can provide or if something definitive change is needed in reframing the question i would be obiliged to highly learned counsels for the same suggested.

As long as this letter wasn't obtained by you fraudulently, there's nothing to worry. Or there could be trouble, if the govt. Says that there is no such document in their record. Beyond these two eventualities, there's nothing to worry.

1) you can in case any notice is issued to you mention that you had only relied upon said document in court proceedings

2) document was not mentioned as confidential or classifed

3)you have not committed any offence in relying upon said document

I believe this has been answered previously.

If the document is a confidential one then you can not use it.

But if the same has been obtained by some other person officially then you can use it.

Meaning thereupon that you can not reproduce the confidential documents anywhere.

Legally, Memorandum is a informal instrument. So, you can not use it in court.

There is no illegality in utilising the said documents provided the contents are verified to be genuine and sources procured are reliable.

Is as per any csr, or any civil or criminal rules or law or act can i be made liable if yes why if no what is quantum of punishment.

Until and unless you has misused your position there is nothing wrong in such issues.

You may not worry about this becasue the authorities will refer to the genuineness of the document and they would not go beyond the source from where you procured such information.

There is no illegality in it.
